Welcome to ladybirddeed.us (the "Site"), operated by Leonid Murashkovskiy, PLLC. By accessing our Site, using our online legal intake tools, or placing an order for document preparation, you agree to comply with and be bound by the following Terms of Service ("Terms"). Please review these Terms carefully before proceeding with your purchase or using our materials.
1. No Legal Advice & No Attorney-Client Relationship
Important Disclaimer: All educational material, articles, case summaries, tables, and discussions available in our Deed Library (Wiki) or elsewhere on this Site are provided for general informational and educational purposes only and do not constitute formal legal advice.
Your use of this Site, including submitting information via our online intake questionnaire, does not create an attorney-client relationship between you and Leonid Murashkovskiy, PLLC. An attorney-client relationship is only created after:
- We successfully complete a conflict-of-interest check;
- We explicitly accept representation; and
- A formal written Engagement Agreement is signed by both you and Leonid Murashkovskiy, PLLC.
2. Document Preparation & Scope of Services
Our service consists of gathering intake questionnaire data from you, verifying matching property ownership files in public county land records, and custom-drafting a Texas Lady Bird Deed (Enhanced Life Estate Deed) tailored to your inputs.
The scope of our document-drafting service is strictly limited to:
- Preparing the custom Enhanced Life Estate Deed based on your inputs.
- Verifying the statutory legal description of the real property.
- Providing easy-to-follow, clear written instructions detailing how you must sign, execute before a Notary Public, and file/record the finalized deed with the specific Texas County Clerk's real property records department.
Our service does not include physically filing or recording the deed for you, representing you in any court hearings, managing contested estate disputes, or performing comprehensive estate tax structuring unless separately contracted in writing.
3. Pricing, Billing, and Refund Policy
We offer two straightforward drafting packages:
- Standard Process: $400. Document is prepared and delivered electronically in 5-7 business days.
- Expedited Process: $500. Priority drafting, with document delivered electronically in 24-48 hours.
Because our attorneys and legal staff begin property records research and document drafting immediately upon receiving your payment and completed intake form, all fees are non-refundable once legal drafting work has commenced.
4. User Responsibilities & Accuracy of Information
To draft a legally sound deed, we rely entirely on the accuracy and completeness of the details you provide. You represent and warrant that:
- All names of grantors, grantees, and spouses match exactly as they appear on your current deed or tax records.
- The property county and legal description are correct.
- You own or represent the legal authority to convey the designated property.
Leonid Murashkovskiy, PLLC, is not liable for deed invalidity, recording rejections, title chain clouds, or other legal disputes arising from inaccurate, false, incomplete, or misspelled inputs supplied by the user.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Leonid Murashkovskiy, PLLC, or its attorneys, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, title insurance rejections, or filing fees. Our total liability for any claim arising from or relating to our services is strictly limited to the actual amount paid by you for the specific document preparation service.
6. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the **State of Texas**, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of or related to these Terms or our services shall be instituted exclusively in the state or federal courts located in the State of Texas (such as Dallas County or Harris County).
